٩ - ب - تَجْدِيدُ الْعَقْدِ: وَيَتَأَتَّى ذَلِكَ فِي الْعُقُودِ الْمُقَيَّدَةِ بِمُدَّةٍ كَالإِْجَارَةِ، فَإِذَا اتَّفَقَ الْعَاقِدَانِ عَلَى تَجْدِيدِ الْعَقْدِ لِمُدَّةٍ أُخْرَى سَقَطَ رَدُّ الْعَيْنِ الْمُؤَجَّرَةِ لِوُرُودِ الْعَقْدِ عَلَيْهَا؛ وَلِزَوَال مَا يُوجِبُهُ وَهُوَ انْتِهَاءُ فَتْرَةِ الْعَقْدِ.
