نَبْشُ الْقَبْرِ لاِسْتِخْرَاجِ الْمَال: ١٢ - صَرَّحَ الْمَالِكِيَّةُ بِأَنَّ مَا يُوجَدُ فِي قَبْرِ الْجَاهِلِيِّ رِكَازٌ. وَأَمَّا مَا يُوجَدُ فِي قَبْرِ الْمُسْلِمِ فَفِي حُكْمِ اللُّقَطَةِ (٣) . وَتَفْصِيل ذَلِكَ فِي مُصْطَلَحِ (قَبْر، وَلُقَطَة) .
