٢٧ - (١) - اشْتِرَاطُ وُجُودِ الدَّعْوَى فِي الشَّهَادَةِ عَلَى حُقُوقِ الْعِبَادِ مِنَ الْمُدَّعِي أَوْ نَائِبِهِ. أَمَّا الشَّهَادَةُ عَلَى حُقُوقِ اللَّهِ تَعَالَى فَلاَ يُشْتَرَطُ فِيهَا وُجُودُ الدَّعْوَى عَلَى رَأْيِ جُمْهُورِ الْفُقَهَاءِ (٢) .
