٩ - أَمَّا الْقَائِلُونَ بِنَجَاسَتِهِ وَهُمُ الشَّافِعِيَّةُ وَالْمَذْهَبُ عِنْدَ الْحَنَابِلَةِ فَلاَ يَجُوزُ بَيْعُهُ عِنْدَهُمْ. قَال النَّوَوِيُّ فِي الْمَجْمُوعِ: لاَ يَجُوزُ بَيْعُهُ وَلاَ يَحِل ثَمَنُهُ، وَبِهَذَا قَال طَاوُسٍ وَعَطَاءُ بْنُ أَبِي رَبَاحٍ وَعُمَرُ بْنُ عَبْدِ الْعَزِيزِ (١) .
