عَزْل الزَّوْجِ الْمَرِيضِ عَنِ الصَّحِيحِ: ٧ - إِذَا أُصِيبَ أَحَدُ الزَّوْجَيْنِ بِمَرَضٍ مُعْدٍ، كَالْجُذَامِ، فَيَرَى الْجُمْهُورُ ثُبُوتَ خِيَارِ الْفَسْخِ لِكُل وَاحِدٍ مِنَ الزَّوْجَيْنِ؛ لإِِثَارَةِ النُّفْرَةِ بَيْنَهُمَا إِنْ كَانَ ذَلِكَ قَبْل الْعَقْدِ.
