٥ - وَاخْتَلَفُوا فِي الدِّفَاعِ عَنِ النَّفْسِ وَالْمَال، فَقَال جُمْهُورُ الْفُقَهَاءِ بِوُجُوبِ الدِّفَاعِ عَنِ النَّفْسِ، وَجَوَازِهِ عَنِ الْمَال. وَذَهَبَ بَعْضُهُمْ بِالْجَوَازِ فِي الصُّورَتَيْنِ (١) . وَتَفْصِيل الْمَوْضُوعِ فِي مُصْطَلَحِ: (صِيَال ف ٥، ١٢) .
