ح - الصَّمَمُ: ١٨ - وَفِي الصَّمَمِ يَجْرِي مَا وَرَدَ فِي الْعَمَى؛ لأَِنَّ الْقَاضِيَ الأَْصَمَّ لاَ يَسْمَعُ قَوْل الْخَصْمَيْنِ وَلاَ إِفَادَةَ الشُّهُودِ، وَالأَْصَحُّ عِنْدَ الْحَنَفِيَّةِ: أَنَّ الأَْطْرَشَ - وَهُوَ مَنْ يَسْمَعُ الصَّوْتَ الْقَوِيَّ - يَصِحُّ قَضَاؤُهُ (١) .
