ب - الْعَيْنُ الْمُؤَجَّرَةُ: ١١ - اخْتَلَفَ الْفُقَهَاءُ فِي غَصْبِ الْعَيْنِ الْمُؤَجَّرَةِ. فَذَهَبَ بَعْضُهُمْ إِلَى أَنَّهُ إِذَا غُصِبَتِ الْعَيْنُ الْمُؤَجَّرَةُ ثَبَتَ الْخِيَارُ لِلْمُسْتَأْجِرِ فِي فَسْخِ الإِْجَارَةِ لِذَهَابِ مَحَل اسْتِيفَاءِ الْمَنْفَعَةِ، أَوْ عَدَمِ الْفَسْخِ. وَفَصَّل آخَرُونَ فِي الْحُكْمِ.
