أَثَرُ الْفِسْقِ فِي الْفَتْوَى: ١١ - ذَهَبَ جُمْهُورُ الْفُقَهَاءِ إِلَى أَنَّ الْفِسْقَ مَانِعٌ مِنْ قَبُول الْفَتْوَى، لأَِنَّ الإِْفْتَاءَ يَتَضَمَّنُ الإِْخْبَارَ عَنِ الْحُكْمِ الشَّرْعِيِّ، وَخَبَرُ الْفَاسِقِ لاَ يُقْبَل. وَذَهَبَ بَعْضُ الْحَنَفِيَّةِ إِلَى أَنَّ الْفَاسِقَ تُقْبَل فَتْوَاهُ. وَالتَّفْصِيل فِي مُصْطَلَحِ (فَتْوَى ف ١٢) .
