الشَّرْطُ الرَّابِعُ: الاِخْتِيَارُ ١٥ - نَصَّ جُمْهُورُ الْفُقَهَاءِ عَلَى أَنَّهُ لاَ يَصِحُّ الأَْمَانُ مِنْ مُكْرَهٍ لأَِنَّهُ قَوْلٌ أُكْرِهَ عَلَيْهِ بِغَيْرِ حَقٍّ، فَلَمْ يَصِحَّ كَالإِْقْرَارِ (٤) .
