ب - الإِِِْغْمَاءُ: ٧٢ - نَصَّ الشَّافِعِيَّةُ عَلَى أَنَّ الإِِِْغْمَاءَ سَبَبٌ تَنْفَسِخُ بِهِ الْمُضَارَبَةُ، فَقَالُوا: إِِذَا أُغْمِيَ عَلَى أَحَدِ طَرَفَيْ عَقْدِ الْمُضَارَبَةِ انْفَسَخَ الْعَقْدُ كَمَا يَنْفَسِخُ بِالْجُنُونِ وَالْمَوْتِ (١) .
