مَدَى سُلْطَانِ الدَّوْلَةِ فِي نَزْعِ الْمِلْكِ ٢٠ - لِلدَّوْلَةِ الْحَقُّ فِي نَزْعِ الْمِلْكِ اسْتِثْنَاءً لِلْمَصْلَحَةِ الْعَامَّةِ قَال ابْنُ حَجَرٍ الْهَيْتَمِيُّ: أَجْمَعَ الْعُلَمَاءُ عَلَى أَنَّهُ لَوْ كَانَ عِنْدَ إِنْسَانٍ طَعَامٌ وَاضْطُرَّ النَّاسُ إِلَيْهِ يُجْبَرُ عَلَى بَيْعِهِ دَفْعًا لِلضَّرَرِ عَنْهُمْ (١) .
