حُكْمُ الْمَسْأَلَةِ النَّاقِصَةِ: ٤ - ذَهَبَ جُمْهُورُ الْعُلَمَاءِ إِلَى وُجُوبِ رَدِّ مَا بَقِيَ مِنْ التَّرِكَةِ بَعْدَ أَسْهُمِ أَصْحَابِ الْفُرُوضِ فِي الْمَسْأَلَةِ النَّاقِصَةِ، وَلَكِنَّهُمُ اخْتَلَفُوا فِيمَنْ يَرُدُّ عَلَيْهِ عَلَى أَقْوَالٍ ثَلاَثَةٍ. وَتَفْصِيل ذَلِكَ فِي مُصْطَلَحِ: (إِرْث ف ٦٣ - ٧٣) .
