الْحُكْمُ التَّكْلِيفِيُّ لِلنَّعْيِ: ٥ - اخْتَلَفَتْ أَقْوَال الْفُقَهَاءِ فِي حُكْمِ النَّعْيِ، حَتَّى فِي الْمَذْهَبِ الْوَاحِدِ، مَا بَيْنَ الاِسْتِحْبَابِ وَالإِْبَاحَةِ وَالْكَرَاهَةِ وَالتَّحْرِيمِ، وَلِذَا اخْتَارَ بَعْضُ الْمُحَقِّقِينَ أَنَّ أَقْوَالَهُمْ لَيْسَتْ مِنْ قَبِيل الْخِلاَفِ فِي الأَْمْرِ إِذْ لَمْ تَتَوَارَدْ عَلَى الصُّورَةِ الْمُطْلَقَةِ لِلنَّعْيِ.
