ثَالِثًا: تَلَفُ نَمَاءِ الْمَبِيعِ: ١٣ - إِذَا تَلِفَ نَمَاءُ الْمَبِيعِ أَوْ هَلَكَ وَهُوَ فِي يَدِ الْبَائِعِ فَهَل يُعَدُّ الْبَائِعُ ضَامِنًا لِتَلَفِ أَوْ هَلاَكِ هَذَا النَّمَاءِ أَمْ لاَ؟ خِلاَفٌ بَيْنِ الْفُقَهَاءِ. انْظُرْ تَفْصِيلَهُ فِي مُصْطَلَحِ (تَلَف ف ١٩، وَضَمَان ف ٣٣) .
