الْحَضَانَةُ: ٦ - تَثْبُتُ الْحَضَانَةُ لِلأُْمِّ الْمُسْلِمَةِ اتِّفَاقًا مَا لَمْ يَكُنْ مَانِعٌ، بَل هِيَ أَوْلَى مِنْ غَيْرِهَا، وَكَذَا الأُْمُّ الْكِتَابِيَّةُ - عَلَى خِلاَفٍ وَتَفْصِيلٍ فِيهَا - وَتَجِبُ عَلَيْهَا الْحَضَانَةُ إِذَا تَعَيَّنَتْ بِأَلاَّ يَكُونَ غَيْرُهَا (٣) . وَلِلتَّفْصِيل: انْظُرْ مُصْطَلَحَ (حَضَانَة) .
