ثَانِيًا: الاِنْضِبَاطُ فِي الْقِصَاصِ: ٤ - يُشْتَرَطُ فِي قِصَاصِ مَا دُونَ النَّفْسِ أَنْ تَكُونَ الْجِنَايَةُ مُنْضَبِطَةً كَالْقَطْعِ مِنَ الْمِفْصَل، فَإِنْ لَمْ يُمْكِنِ انْضِبَاطُهُمَا كَالْجَوَائِفِ فَلاَ يَجِبُ، بِخِلاَفِ قِصَاصِ النَّفْسِ فَلاَ يُشْتَرَطُ الاِنْضِبَاطُ فِي جِرَاحَتِهِ الَّتِي سَرَتْ إِلَيْهَا.
