ثَالِثًا: الاِنْضِبَاطُ فِي الْعَيْنِ الْمُدَّعَاةِ: ٥ - عَلَى الْمُدَّعِي إِذَا ادَّعَى عَيْنًا تَنْضَبِطُ أَنْ يَصِفَهَا بِصِفَةِ السَّلَمِ، وَلاَ فَرْقَ فِي ذَلِكَ بَيْنَ أَنْ تَكُونَ الْعَيْنُ مِثْلِيَّةً كَالْحُبُوبِ، أَوْ قِيَمِيَّةً كَالْحَيَوَانِ، عَلَى خِلاَفٍ وَتَفْصِيلٍ يُرْجَعُ إِلَيْهِ فِي بَابِ السَّلَمِ.
