الْحُكْمُ الإِْجْمَالِيُّ: ٢ - ذَهَبَ جُمْهُورُ الْفُقَهَاءِ إِلَى أَنَّ فِي الْبَازِلَةِ حُكُومَةَ عَدْلٍ فِي الْعَمْدِ وَغَيْرِهِ، وَقَال الْمَالِكِيَّةُ: فِيهَا الْقِصَاصُ فِي الْعَمْدِ. وَلَمَّا كَانَتِ الْبَازِلَةُ مِنْ أَنْوَاعِ الْجِرَاحِ فِي الْجِنَايَاتِ تَكَلَّمَ الْفُقَهَاءُ عَنْهَا فِي الْقِصَاصِ وَالدِّيَاتِ.
