الاِسْتِحْقَاقُ فِي الإِْجَارَةِ: ١٥٣ - اخْتَلَفَ الْفُقَهَاءُ فِي أَثَرِ اسْتِحْقَاقِ الْعَيْنِ الْمُؤَجَّرَةِ، فَمِنْهُمْ مَنْ يَرَى بُطْلاَنَ الإِْجَارَةِ وَمِنْهُمْ مَنْ يَرَى تَوَقُّفَهَا عَلَى إِجَازَةِ الْمُسْتَحِقِّ كَمَا اخْتَلَفُوا فِيمَنْ يَسْتَحِقُّ الأُْجْرَةَ عَلَى خِلاَفٍ وَتَفْصِيلٍ، يُنْظَرُ بَحْثُ (اسْتِحْقَاق) .
