بَيْعُ مَا يُقْصَدُ بِهِ فِعْل مُحَرَّمٍ: ١١٢ - ذَهَبَ الْجُمْهُورُ إِلَى أَنَّ كُل مَا يُقْصَدُ بِهِ الْحَرَامُ، وَكُل تَصَرُّفٍ يُفْضِي إِلَى مَعْصِيَةٍ فَهُوَ مُحَرَّمٌ، فَيَمْتَنِعُ بَيْعُ كُل شَيْءٍ عُلِمَ أَنَّ الْمُشْتَرِيَ قَصَدَ بِهِ أَمْرًا لاَ يَجُوزُ (٣) .
