أَمَّا الْمَالِكِيَّةُ: فَظَاهِرُ كَلاَمِهِمْ نَفَاذُهُ بَعْدَ الْوُقُوعِ. (٤) ٨ - وَطَرَفَا التَّحْكِيمِ هُمَا الْخَصْمَانِ اللَّذَانِ اتَّفَقَا عَلَى فَضِّ النِّزَاعِ بِهِ فِيمَا بَيْنَهُمَا، وَكُلٌّ مِنْهُمَا يُسَمَّى الْمُحَكِّمَ بِتَشْدِيدِ الْكَافِ الْمَكْسُورَةِ.
