قَطْعُ سَارِقِ كُتُبِ التَّفْسِيرِ: ١٢ - اخْتَلَفَ الْفُقَهَاءُ فِي قَطْعِ سَارِقِ كُتُبِ التَّفْسِيرِ، فَذَهَبَ مَالِكٌ وَالشَّافِعِيُّ وَالْحَنَابِلَةُ وَأَبُو ثَوْرٍ إِلَى وُجُوبِ الْقَطْعِ بِسَرِقَتِهَا إِذَا تَمَّتْ شُرُوطُ الْقَطْعِ. وَذَهَبَ الْحَنَفِيَّةُ إِلَى عَدَمِ الْقَطْعِ عَلَى تَفْصِيلٍ يَرْجِعُ فِيهِ إِلَى مُصْطَلَحِ (سَرِقَةٌ) .
