هـ - الْحَبْسُ لِتَعَذُّرِ الْقِصَاصِ فِي الضَّرْبِ وَاللَّطْمِ: ٥٠ - نَصَّ الْحَنَفِيَّةُ وَالْمَالِكِيَّةُ عَلَى إِطَالَةِ حَبْسِ مَنْ ضَرَبَ غَيْرَهُ بِغَيْرِ حَقٍّ، إِذَا احْتَاجَ إِلَى زِيَادَةِ تَأْدِيبٍ لِعَظِيمِ مَا اقْتَرَفَ. وَقَال آخَرُونَ بِالتَّعْزِيرِ عَامَّةً. وَذَهَبَ ابْنُ تَيْمِيَّةَ إِلَى الْقِصَاصِ فِي ذَلِكَ (١) .
