١٦٥٥ - مَسْأَلَةٌ: وَلَا يُبْطِلُ الْحَبْسَ تَرْكُ الْحِيَازَةِ، فَإِنْ اسْتَغَلَّهُ الْمُحْبِسُ وَلَمْ يَكُنْ سَبَّلَهُ عَلَى نَفْسِهِ فَهُوَ مَضْمُونٌ عَلَيْهِ، كَالْغَصْبِ، وَلَا يَحِلُّ إلَّا فِيمَا أَبْقَى غِنًى وَهُوَ جَائِزٌ فِي الْمُشَاعِ وَغَيْرِ الْمُشَاعِ - فِيمَا يَنْقَسِمُ وَفِيمَا لَا يَنْقَسِمُ - وَالْحُجَّةُ فِي ذَلِكَ قَدْ ذَكَرْنَاهَا فِي كَلَامِنَا فِي " الْهِبَاتِ وَالصَّدَقَاتِ " وَلِلَّهِ الْحَمْدُ كَثِيرًا. [مَسْأَلَة التَّسْوِيَةُ بَيْنَ الْوَلَدِ فَرْضٌ فِي الْحَبْسِ]
