١٨١٣ - مَسْأَلَةٌ: وَجَائِزٌ لِلْإِمَامِ أَنْ يَعْزِلَ الْقَاضِيَ مَتَى شَاءَ عَنْ غَيْرِ خَرِبَةٍ، قَدْ «بَعَثَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَلِيًّا إلَى الْيَمَنِ قَاضِيًا، ثُمَّ صَرَفَهُ حِينَ حَجَّةِ الْوَدَاعِ وَلَمْ يَرْجِعْ إلَى الْيَمَنِ بَعْدَهَا» . [مَسْأَلَة قَالَ لَهُ قَاضٍ قَدْ ثَبَتَ عَلَى هَذَا الصَّلْبُ أَوْ الْقَتْلُ وَغَيْر ذَلِكَ]
