فصل خِيَارُ الْعَيْبِ وأحكامه] فَصْلٌ (مُطْلَقُ الْبَيْعِ يَقْتَضِي سَلَامَةَ الْمَبِيعِ) لِأَنَّ الْأَصْلَ هُوَ السَّلَامَةُ، وَهُوَ وَصْفٌ مَطْلُوبٌ مَرْغُوبٌ عَادَةً، وَالْمَطْلُوبُ عُرْفًا كَالْمَشْرُوطِ نَصًّا.
