الاختيار لتعليل المختارal-Mawsili

كِتَابُ الرَّضَاعِ وَحُكْمُ الرَّضَاعِ يَثْبُتُ بِقَلِيلِهِ (ف) ، وَكَثِيرِهِ.

[الاختيار لتعليل المختار] لِأَنَّ الْمُسْتَحَقَّ عَلَيْهِ التَّسْوِيَةُ، وَقَدْ وُجِدَتْ.

قَالَ: (وَلِلْحُرَّةِ ضِعْفُ الْأَمَةِ) ؛ لِمَا عُرِفَ أَنَّ الرِّقَّ مُنْصِفٌ كَمَا فِي الْعِدَّةِ وَغَيْرِهَا.
