[الاختيار لتعليل المختار] قَالَ: (فَإِنْ مَاتَ أَحَدُهُمَا بَعْدَ الْقَضَاءِ أَوِ الِاصْطِلَاحِ قَبْلَ الْقَبْضِ سَقَطَتْ) لِمَا بَيَّنَّا أَنَّهَا صِلَةٌ، وَالصِّلَةُ تَسْقُطُ بِالْمَوْتِ كَالْهِبَةِ قَبْلَ الْقَبْضِ.
