فصل في النفس الدية]] فَصْلٌ (وَفِي النَّفْسِ الدِّيَةُ) لِمَا رُوِّينَا، وَالْمُرَادُ نَفْسُ الْحُرِّ وَيَسْتَوِي فِيهِ الصَّغِيرُ وَالْكَبِيرُ وَالْوَضِيعُ وَالشَّرِيفُ وَالْمُسْلِمُ وَالذِّمِّيُّ لِاسْتِوَائِهِمْ فِي الْحُرْمَةِ وَالْعِصْمَةِ وَكَمَالِ الْأَحْوَالِ فِي الْأَحْكَامِ الدُّنْيَوِيَّةِ.
