قَالَ: (وَإِنْ لَمْ يَكُنْ مِنْ أَهْلِ الدِّيوَانِ فَعَاقِلَتُهُ قَبِيلَتُهُ) وَهُمْ عَصَبَتُهُ مِنَ النَّسَبِ لِمَا رُوِيَ «أَنَّهُ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَوْجَبَ الدِّيَةَ عَلَى عَصَبَةِ الْقَاتِلِ» ، وَلِأَنَّ تَنَاصُرَهُمْ بِالْقُرْبِ.
