قال: "وإذا قتل جماعة واحدا عمدا اقتص من جميعهم" لقول عمر رضي الله عنه فيه: لو تمالأ عليه أهل صنعاء لقتلتهم، ولأن القتل بطريق التغالب غالب، والقصاص مزجرة للسفهاء فيجب تحقيقا لحكمة الإحياء.
