باب خيار الشرط] خيار الشرط جائز في البيع للبائع والمشتري "ولهما الخيار ثلاثة أيام فما دونها والأصل" فيه ما روي: أن حبان بن منقذ بن عمرو الأنصاري رضي الله عنه كان يغبن في البياعات، فقال له النبي عليه الصلاة والسلام : "إذا بايعت فقل لا خلابة ولي الخيار ثلاثة أيام" .
