ويستحلف السَّارِق فَإِن نكل ضمن وَلم يقطع

قال: "ويستحلف السارق، فإن نكل ضمن ولم يقطع" لأن المنوط بفعله شيئان: الضمان ويعمل فيه النكول. والقطع ولا يثبت به فصار كما إذا شهد عليها رجل وامرأتان.
