قال: "ويضمن الأول لشريكه في قياس قول أبي يوسف رحمه الله نصف قيمتها مكاتبة" لأنه تملك نصيب شريكه وهي مكاتبة فيضمنه موسرا كان أو معسرا لأنه ضمان التملك.
