" وَلَوْ رضيت به " أي بما ذكر مِنْ أَخْذِهِ نِصْفَ النَّخْلِ وَتَبْقِيَةِ الثَّمَرِ إلَى جِذَاذِهِ " فَلَهُ امْتِنَاعٌ " مِنْهُ " وَقِيمَةٌ " أَيْ طَلَبُهَا لِأَنَّ حَقَّهُ نَاجِزٌ فِي الْعَيْنِ أَوْ الْقِيمَةِ فَلَا يُؤَخَّرُ إلَّا بِرِضَاهُ
