(و) يجوز أيضًا (من) سلطان (أهل البغي) وهم خرجوا عن طاعة الإمام العدل كما مر ولا خفاء أن صحة التولية تعتمد صحة العزل،

وقيل: لا ينفذه، وبه جزم الناصحي في (تهذيب أدب القضاء) للخصاف، وجعل الخوارج كالبغاة معللًا بأنهم يستحلون أموالهم فلا تجوز شهادتهم وإذا لم تجز فلا يجوز قضاؤه.
