(إلا على أهل مكة) ومن هو في حكمهم لمن كان داخل المواقيت

وكذا الآفاقي الذي اتخذ مكة دارا يعني استوطنها، حتى لو لم يستوطنها وأقام بها سنين لم يسقط عنه، وقيد في (البدائع) بأن ينويها قبل أن يحل النفر الأول

أما إذا نوايا بعد لم يسقط عنه في قول الإمام خلافا للثاني لأنه نوابا في الأول قبل طواف الصدر لأنه وضع لختم أفعال الحج وهذا المعنى موجود في حقهم،
