* قوله: (ومصرفه كفيءٍ) ؛ أيْ: كغيره من بقية الفيء، إذ هو من الفيء أيضًا، أو يقال: الفيء خاص بما أخذ من مال [كافر بحق بلا قتال]، فيكون التشبيه على حقيقته، إلا أن يقال: إن التقييد بقوله: (كافر) -فيما يأتي - أغلبي.
