(لَا) يَلْزَمُهُ إخْبَارٌ (بِأَخْذِ نَمَاءٍ وَاسْتِخْدَامٍ وَوَطْءٍ لَمْ يُنْقِصْهُ) الْوَطْءُ كَبِكْرٍ فَيَلْزَمُهُ الْإِخْبَارُ بِهِ كَمَا لَوْ وَطِئَهَا غَيْرُهُ وَأَخَذَ الْأَرْشَ

معونة أولي النهىIbn al-Najjar

(لا) يلزمه أن يخبر (بأخذ نماء، واستخدام، ووطء ما لم ينقصه) أي: ينقص الوطء المبيع؛ كوطء البكر أو الثيب التي تنقص به. فيجب عليه الإخبار به، كما لو وطئها غيره وأخذ الأرش.
