(بِخِلَافِ شِرَائِهِ) أَيْ: الشَّرِيكِ أَوْ وَلِيِّ الْيَتِيمِ (خَمْرًا) لِلشَّرِكَةِ أَوْ لِلْيَتِيمِ (جَاهِلًا) بِهِ فَيَضْمَنُ نَصًّا ; لِأَنَّهُ لَا يَخْفَى غَالِبًا
