(وَتَتَعَيَّنُ دِيَةٌ لِقَوَدٍ لَزِمَ بَعْدَ مُحَارَبَتِهِ) بِأَنْ قَتَلَ بَعْدَهَا عَمْدًا مُكَافِئًا (لِتَقْدِيمِهَا) أَيْ: الْمُحَارَبَةِ (بِسَبْقِهَا، وَكَذَا لَوْ مَاتَ) مُحَارِبٌ لَزِمَهُ قَوَدٌ بَعْدَ مُحَارَبَتِهِ
