(قَوْلُهُ وَإِنْ قَالَ: اسْتَوْفَيْت حَقِّي ثُمَّ قَالَ: أَخَذْت بَعْضَهُ فَالْقَوْلُ قَوْلُ خَصْمِهِ مَعَ يَمِينِهِ) لِأَنَّهُ أَقَرَّ بِتَمَامِ الْقِسْمَةِ وَاسْتِيفَائِهِ لِنَصِيبِهِ ثُمَّ ادَّعَى حَقًّا عَلَى خَصْمِهِ وَهُوَ مُنْكِرٌ فَلَا تُقْبَلُ عَلَيْهِ إلَّا بِبَيِّنَةٍ.
