(وإن وجدوها بعد القسمة أخذوها بالقيمة إن أحبوا) لأن من وقع المال في نصيبه يتضرر بالأخذ منه مجانا؛ لأنه استحقه عوضاً عن سهمه في الغنيمة، فقلنا بحق الأخذ بالقيمة لما فيه من النظر للجانبين كما في الهداية
