قَوْلُهُ: (فَإِنْ كَانَ لِلْمُعْتِقِ عَصَبَةٌ مِنْ النَّسَبِ فَهُمْ أَوْلَى مِنْهُ) لِأَنَّ مَوَالِي الْعَتَاقَةِ آخِرُ الْعَصَبَاتِ وَإِنَّمَا يَرِثُ إذَا لَمْ يَكُنْ عَصَبَةٌ مِنْ النَّسَبِ.
