(وَلِأَجْنَبِيٍّ وَوَارِثِهِ أَوْ قَاتِلِهِ نِصْفُ الْوَصِيَّةِ وَبَطَلَ وَصِيَّتُهُ لِلْوَارِثِ وَالْقَاتِلِ) لِأَنَّهُمَا مِنْ أَهْلِ الْوَصِيَّةِ عَلَى مَا مَرَّ، وَلِذَا تَصِحُّ بِإِجَازَةِ الْوَارِثِ
