(وَلَا يَصِحُّ) عَقْدُهَا (إلَّا مِنْ إمَامٍ أَوْ نَائِبِهِ) لِتَعَلُّقِ نَظَرِ الْإِمَامِ بِهِ، دِرَايَتُهُ بِجِهَةِ الْمَصْلَحَةِ، وَلِأَنَّهُ مُؤَبَّدٌ فَعَقْدُهُ مِنْ غَيْرِ الْإِمَامِ افْتِئَاتٌ عَلَيْهِ
