(وَلَا يُعْتَبَرُ) لِصِحَّةِ الْكَفَالَةِ (رِضَى مَكْفُولٍ وَلَا مَكْفُولٍ لَهُ) ؛ لِأَنَّهَا وَثِيقَةٌ لَا قَبْضَ فِيهَا، فَصَحَّتْ مِنْ غَيْرِ رِضَاهُمَا كَالشَّهَادَةِ.
