وَحَرُمَ أَخذُ رِزقٍ وَجُعلٍ وَأَجْرٍ عَلَى قَاصِرٍ كَصَوْمٍ وَصَلَاةٍ خَلفَهُ وَعِبَادَتُهُ لِنَفسِهِ.

مطالب أولي النهىal-Ruhaybani

(وَحَرُمَ أَخْذُ رِزْقٍ وَ) أَخْذُ (جُعْلٍ وَ) أَخْذُ (أَجْرِ عَلَى) فِعْلٍ (قَاصِرٍ) عَلَى فَاعِلِهِ لَا يَتَعَدَّى نَفْعُهُ؛ (كَصَوْمٍ وَصَلَاةٍ خَلْفَهُ) ؛ بِأَنْ أَعْطَى لِمَنْ يُصَلِّي مَأْمُومًا مَعَهُ جُعْلًا وَأُجْرَةً أَوْ رِزْقًا، (وَعِبَادَتُهُ لِنَفْسِهِ) ؛ لِأَنَّ الْأَجْرَ عِوَضُ الِانْتِفَاعِ؛ فَأَشْبَهَ إجَارَةَ الْأَعْيَانِ الَّتِي لَا نَفْعَ فِيهَا.
