(وَيَتَّجِهُ) أَنَّهُ (لَا يَضْمَنُ مَنْ) حَفَرَ بِئْرًا فِي مَوَاتٍ وَنَحْوِهَا، وَلَمْ يَجْعَلْ عَلَيْهَا حَاجِزًا، أَوْ (لَمْ يَسُدَّ بِئْرَهُ سَدًّا يَمْنَعُ الضَّرَرَ) ، خِلَافًا لِلشَّيْخِ تَقِيِّ الدِّينِ حَيْثُ أَوْجَبَ عَلَيْهِ ضَمَانَ مَا تَلِفَ بِهَا.
